Provisional Damages
If your injury is expected to get worse in the future, but you do not know when or even if it definitely will happen, it is still possible for this to be taken into account. This is known as "provisional damages".
The court will assess the value of your injury as it stands at the time of the trial, but will also make an order allowing you to come back to court if your injury gets worse. It must amount to a "serious deterioration".
