What should be included in an employment contract?


Right to Return to Work

1. The employee has the right to return to work after the 26 weeks of Maternity Leave. This is known as Ordinary Maternity Leave.

2. Or if she does not return then she may return up to a further 26 weeks from the Ordinary Maternity Leave Period. This is known as Additional Maternity Leave.

If the employee wishes to return before Ordinary or Additional Maternity Leave has expired, the employee must inform the employer in writing that she intends to return to work. The employee must give the employer 28 days notice.

No notice needs to be given by an employee intending to return to work at the end of Ordinary Maternity Leave or Additional Maternity Leave.
