Provisional Damages
Provisional damages (compensation) are paid in personal injury case where the nature of the injury is such that it may get worse over time or where the injury may cause further related health problems in the future. This uncertainty means that a court will allow provisional compensation and for the injured party to come back within a specified period of time to claim further damages, if their injuries get worse or another health problem develops because of the initial accident. Examples include, where an injured party loses sight in one eye and there is a risk that they may lose sight in their other eye.
