Children Act Orders
The Children Act 1989 was brought in to try and protect children more effectively.
The key principles behind the 1989 Act are:
- The welfare of the child is paramount - the only concern of the court is what is best for the child.
- The concept of parental responsibility replaces parental rights
- Children can be parties in any court proceedings, separate from their parents.
- Local authorities have a duty to identify and protect child in need.
- Courts orders should only be made if they are better for the child than no order.
- Any delay in making an order or decision is likely to be detrimental to the child.
If you or your partner cannot decide what is best for your children then the court will make the decision for you.
