CompactLaw Employers Pack Licence
- 1. CompactLaw.co.uk
- 1.1 These Terms & Conditions govern the use of the CompactLaw Employers Pack software, (the "Pack"), whether shipped as a digital download or physical CD product.
- 1.2 COMPACTLAW, the sunflower logo and LAWRIGHTS are the registered trademarks of CompactLaw and must not be used in any form without the express prior written approval of CompactLaw.
- 2. Introduction
- 2.1 The Pack is a software solution for generating employment contracts, policies and letters for use by employers in the workplace. The Pack also incorporates sections on Health & Safety, Human Resources and a free Business section.
- 2.2 A standard product licence for the Pack entitles a Customer to use the Pack and related legal and technical support.
- 3. Customer Information
- Customers should always check the contact information they provide is correct before proceeding to payment.
- 4. Product Pricing and Title
- 4.1 CompactLaw makes every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by CompactLaw at anytime up to the shipment of that order and any related items, (such as software product activation keys).
- 4.2 CompactLaw reserves the right to alter all product pricing without notice.
- 4.3 Title in any products ordered from CompactLaw does not pass to the purchaser until a valid payment has been received by CompactLaw.
- 4.4 CompactLaw reserves the right to refuse any transaction without providing notice or reasons. In such circumstances a full refund will be made.
- 5. Cancellation Right
- 5.1 The Pack is intended solely for business use and is not a consumer product as such the Consumer Protection (Distance Selling) Regulations 2000 do not apply to this product.
- 5.2 No right of cancellation or refund exists under Regulation 13 of the Consumer Protection (Distance Selling) Regulations 2000 once the Pack has been either downloaded by you after purchase or where the physical product has been shipped to you and the CD packaging has been opened.
- 6. Customer Complaints
- CompactLaw endeavours to respond to complaints within 5 working days.
- 7. Shipping
- 7.1 The CD version of the Pack will only be shipped within the UK. CompactLaw will refund all overseas orders for the CD version of the Pack and the customer will be directed to the download version of the Pack.
- 7.2 Where possible CompactLaw will ship the CD version of the Pack either the same day as receiving the order (if the order is received during a normal work day) or the next working day, subject to availability.
- 7.3 CompactLaw reserves the right to ship the CD version of the Pack at a later date (up to 28 days after purchase) where the Pack is not in stock at the time of purchase. In this situation any Customer affected will be offered a full refund instead of delivery of the Pack.
- 7.4 CompactLaw cannot be held responsible for disruption to shipping caused by industrial disputes or action outside the direct control of CompactLaw. If such disruption occurs Customers will be offered delivery via an alternative delivery or fulfilment company or a full refund.
- 8. Downloads
- 8.1 Where a Customer purchases a download version of the Pack they will also receive an email from CompactLaw containing their required product activation key. This key is required to allow the proper installation of the Pack on a computer.
- 8.2 CompactLaw reserves the right to delay or refuse to deliver a product activation key where the Customer's transaction contains incomplete details or details that cannot be verified or where fraud is suspected.
- 8.3 If CompactLaw is unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time or purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.
- 9. Returns
- 9.1 Unopened CD versions of the Pack may be returned promptly by customers to the address listed below:

HP23 4BB - 9.2 It is the Customer's responsibility to ensure that returned CD is properly packed and that full postage is paid. If CompactLaw receives the returned CD and has to pay postage for the return an amount equal to the postage paid by CompactLaw will be deducted from the refund.
- 9.3 CompactLaw will not issue any refunds for incomplete and/or damaged returns. The CD and all packaging must be returned in good condition. Furthermore it is the Customer's duty to ensure that the complete product reaches the CompactLaw offices. CompactLaw will not issue refunds for any items lost or stolen in transit to CompactLaw.
- 10. Faulty Products
- Where a Customer experiences a fault with the CD it can be returned to Compactlaw, subject to our returns policy. CompactLaw will only ship a replacement product and not issue a refund. A replacement product will only be shipped once the faulty product has been received complete and undamaged.
- 11. Copyright & Licence
- 11.1 A standard product license for the Pack entitles a Customer to use the Pack and related legal and technical support within the Customer organisation.
- 11.2 The purchase the Pack gives the Customer a license to use the documents and legal information contained therein for the period of the license, subject to limitations described in these terms and conditions.
- 11.3 All the forms and resulting documents are and remain the copyright of CompactLaw. Furthermore the copyright notice and document reference details at the end of each document shall not be removed or altered in anyway by the Customer.
- 11.4 Customers may not re-sell, re-publish, copy or distribute the Pack or any CompactLaw document or any part thereof for use by any third party, including another organisation within a group.
- 11.5 Customers may not share their unique username or password used to access and download updates & upgrades to the Pack with any third party.
- 11.6 Customers must notify CompactLaw of any changes to their contact details, including their email address.
- 11.7 Customers must not use the email address supplied at the time of purchase to forward service announcements or notice of updates sent by CompactLaw regarding the Pack to another email address, whether it is their email address or that of a third party.
- 11.8 CompactLaw reserves the right to withdraw access to Pack updates & upgrades without prior warning where it is believed that usernames and passwords have been disclosed to a third party.
- 11.9 Furthermore CompactLaw is not required to show absolute proof that either the Pack or any part thereof has been copied or redistributed or that usernames & passwords have been distributed to a third party or parties.
- 11.10 If you suspect that a third party is using your username & password you should contact CompactLaw immediately.
- 11.11 CompactLaw will not issue any refunds either in full or part where access to Pack updates & upgrades is withdrawn due to a breach of these Terms & Conditions by the Customer.
- 11.12 CompactLaw reserves the right to obtain injunctions and to seek damages from both the Customer and the third party where it is believed that the Pack or any part thereof has been copied or redistributed or that usernames & passwords have been distributed to a third party or parties.
- 12. Liability
- 12.1 CompactLaw tries to ensure that all documents or information contained within the Pack or any other part of www.compactlaw.co.uk or www.employerspack.co.uk are accurate and reflect the law at the time of use.
- 12.2 However, neither CompactLaw, its directors or officers, partners of CompactLaw, or third party sales agents shall be liable for any losses whether direct or indirect that arise from relying upon the documents or information within either the Pack or any other part of www.compactlaw.co.uk or www.employerspack.co.uk. Or where the Customer decides to act or not to act based upon the information contained within the Pack. All implied warranties are hereby excluded, to the maximum extent permitted by law.
- 12.3 Neither the contents of the Pack or any other part of www.compactlaw.co.uk or www.employerspack.co.uk constitute individual legal advice. All of our services should be used in conjunction with proper legal advice where required.
- 13. Viruses
- All software CDs and software downloads and updates issued by CompactLaw are checked for viruses prior to distribution. However, CompactLaw is under no liability whatsoever for any damage, howsoever caused to any computer hardware, operating systems or software owned or used by the Customer where such damage is caused by a virus or fault contained within a CompactLaw product.
- 14. Access to www.compactlaw.co.uk & www.employerspack.co.uk
- 14.1 CompactLaw takes all reasonable steps to ensure that both www.compactlaw.co.uk & www.employerspack.co.uk are available and functioning fully at all times. However, CompactLaw does not accept any responsibility for "down-time" or poor performance of CompactLaw fileservers or where any CompactLaw service is unavailable for any other reason, whether within or outside the direct control of CompactLaw.
- 14.2 Furthermore CompactLaw reserves the right to bar users or customers from access to either www.compactlaw.co.uk or www.employerspack.co.uk and any services contained within where a user or customer commits or seeks to commit fraud or attempts to disrupt in any way the services offered on either www.compactlaw.co.uk or www.employerspack.co.uk.
- 15. Alteration of www.compactlaw.co.uk & www.employerspack.co.uk
- 15.1 CompactLaw is free to alter or revise both www.compactlaw.co.uk & www.employerspack.co.uk at any time and without the requirement to notify users.
- 15.2 However, CompactLaw will take all reasonable steps to inform Customers of changes to the Pack via the original email address supplied by the Customer at the time of purchase of the Pack.
- 16. Force Majeure
- CompactLaw shall be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond its reasonable control, including but not limited to acts of god, war, civil disorder or industrial dispute.
- 17. Acceptance
- Your use of www.compactlaw.co.uk & www.employerspack.co.uk and any service contained within constitutes acceptance of these Terms & Conditions.
- 18. Entire Terms & Conditions
- These Terms & Conditions set out the entire agreement and understanding between you and CompactLaw.
- 19. Severability
- The foregoing paragraphs, sub-paragraphs and clauses of these Terms & Conditions shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.
- 20. Waiver by CompactLaw
- Failure by either CompactLaw to enforce any accrued rights under these Terms & Conditions is not to be taken as or deemed to be a waiver of those rights unless CompactLaw acknowledges the waiver in writing.
- 21. Jurisdiction
- 21.1 The sites www.compactlaw.co.uk & www.employerspack.co.uk are intended for the jurisdiction of England & Wales and as such should not be specifically used or relied upon for any other jurisdiction. CompactLaw does not accept responsibility for any such use.
- 21.2 These Terms & Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts
